Surviving Partners.

§ 59‑74.  Survivingpartner to give bond.

Upon the death of any memberof a partnership, the surviving partner shall, within 30 days, execute beforethe clerk of the superior court of the county where the partnership businesswas conducted, a bond payable to the State of North Carolina, with sufficientsurety conditioned upon the faithful performance of his duties in thesettlement of the partnership affairs. The amount of such bond shall be fixedby the clerk of the court; and the settlement of the estate and the liabilityof the bond shall be the same as under the law governing administrators andtheir bonds.
