§ 59B‑8.  Capacity toassert and defend; standing.

(a)        A nonprofitassociation, in its name, may institute, defend, intervene, or participate in ajudicial, administrative, or other governmental proceeding or in anarbitration, mediation, or any other form of alternative dispute resolution.

(b)        A nonprofitassociation may assert a claim in its name on behalf of its members or personsreferred to as "members" by the nonprofit association if one or moreof them have standing to assert a claim in their own right, the interests thenonprofit association seeks to protect are germane to its purposes, and neitherthe claim asserted nor the relief requested requires the participation of amember or a person referred to as a "member" by the nonprofit association.(2006‑226,s. 1.)
