§ 62‑184.  Dwellinghouse of owner, etc., may be taken under certain cases.

The dwelling house, yard, kitchen, garden or burial ground of the ownermay be taken under G.S. 62‑183 when the company alleges, and upon theproceedings to condemn makes it appear to the satisfaction of the court, thatit owns or otherwise controls not less than seventy‑five percent (75%) ofthe fall of the river or stream on which it proposes to erect its works, fromthe location of its proposed dam to the head of its pond or reservoir; or whenthe Commission, upon the petition filed by the company, shall, after dueinquiry, so authorize. Nothing in this section repeals any part or feature ofany private charter, but any firm or corporation acting under a private chartermay operate under or adopt any feature of this section.
