§ 77‑88.  Enforcement.

(a)        Where a municipalordinance so provides, all law enforcement officers, or those officers as maybe designated in the municipal ordinance, with territorial jurisdiction as toany part of the waters of Lake Lure or its shoreline area within thelimitations of their subject matter jurisdiction, have the authority of peaceofficers in enforcing the laws over all of the waters of Lake Lure and itsshoreline area. A certificate of training issued by the North Carolina CriminalJustice Education and Training Standards Commission or the North CarolinaSheriffs' Education and Training Standards Commission will suffice forcertification for the purposes of this Article.

(b)        Where a lawenforcement officer with jurisdiction over any part of the waters of Lake Lureor its shoreline area is performing duties relating to the enforcement of thelaws on the waters of Lake Lure or in its shoreline area, the officer shallhave such extraterritorial jurisdiction as may be necessary to perform the officer'sduties. These duties include investigations of crimes an officer reasonablybelieves have been, or are about to be, committed within the area in question.This includes traversing by reasonable routes from one portion of this area toanother although across territory not within the boundaries of the waters ofLake Lure and its shoreline area; conducting prisoners in custody to a court orto detention facilities as may be authorized by law, although this may involvegoing outside the area in question; execution of process connected with anycriminal offense alleged to have been committed within the boundaries inquestion, except that this process may not be executed by virtue of thisprovision beyond the boundaries of Rutherford County. This also includescontinuing pursuit of and arresting any violator or suspected violator as towhich grounds for arrest arose within the area in question.

(c)        Reserved for futurecodification purposes.

(d)        Where lawenforcement officers are given additional territorial jurisdiction under theprovisions of this section, this shall be considered an extension of the dutiesof the office held, and no officer shall take any additional oath or title ofoffice. (2003‑332,s. 1.)
