§ 90‑650. Appointments and removal of Board members; terms and compensation.

(a)        The members of the Board shall be appointed as follows:

(1)        The Governor shall appoint the public members described inG.S. 90‑649(a)(5).

(2)        The General Assembly, upon the recommendation of the Speakerof the House of Representatives, shall appoint one of the respiratory carepractitioner members described in G.S. 90‑649(a)(1) and one of thephysician members described in G.S. 90‑649(a)(2) in accordance with G.S.120‑121.

(3)        The General Assembly, upon the recommendation of thePresident Pro Tempore of the Senate, shall appoint one of the respiratory carepractitioner members described in G.S. 90‑649(a)(1) and one of thephysician members described in G.S. 90‑649(a)(2) in accordance with G.S.120‑121.

(4)        The North Carolina Medical Society shall appoint one of thephysician members described in G.S. 90‑649(a)(2).

(5)        The Old North State Medical Society shall appoint one of thephysician members described in G.S. 96‑649(a)(2).

(6)        The North Carolina Hospital Association shall appoint themember described in G.S. 90‑649(a)(3).

(7)        The North Carolina Association of Medical Equipment Servicesshall appoint the member described in G.S. 90‑649(a)(4).

(b)        Members of the Board shall take office on the first day ofNovember immediately following the expired term of that office and shall servefor a term of three years and until their successors are appointed andqualified. No member shall serve on the Board for more than two consecutive terms.

(c)        The Governor may remove members of the Board, after noticeand an opportunity for hearing, for incompetence, neglect of duty,unprofessional conduct, conviction of any felony, failure to meet thequalifications of this Article, or committing any act prohibited by thisArticle.

(d)        Any vacancy shall be filled by the authority originallyfilling that position, except that any vacancy in appointments by the GeneralAssembly shall be filled in accordance with G.S. 120‑122. Appointees tofill vacancies shall serve the remainder of the unexpired term and until theirsuccessors have been duly appointed and qualified.

(e)        Members of the Board shall receive no compensation for theirservices but shall be entitled to travel, per diem, and other expenses authorizedby G.S. 93B‑5.

(f)         Individual members shall be immune from civil liabilityarising from activities performed within the scope of their official duties. (2000‑162, s. 1.)
