§27-1A-12. Lesage tree nursery transferred from department of natural resources to department of mental health; use as center for mentally retarded.
On and after the effective date of this section, that certain parcel of land known as the Lesage state forest tree nursery located in Cabell county and owned by the state of West Virginia for the use and benefit of the department of natural resources shall be held for the sole use and benefit of the department of mental health or the establishment of a regional center for the care and treatment of the mentally retarded, and shall be under the exclusive control and jurisdiction of said department of mental health, and the department of natural resources shall thereupon have no further rights or interests in, or privileges, responsibilities or obligations with respect to, said tract of land.

In establishing and developing said center, the director of the department of mental health is hereby authorized and empowered to lease said premises on a long-term basis for and on behalf of the state of West Virginia to a political subdivision of this state or any nonprofit group, agency or corporation qualified to operate a center for the care and treatment of the mentally retarded.

Before the director shall enter into such a lease, said political subdivision, local group, agency or corporation shall first present to the director a comprehensive plan for the use, development and establishment of said center for his approval.
