53-4-32. (Pre-1998 Probate Code) Filing of petition by person claiming to be heir or distributee; contents of petition; verification


Any person who deems himself to be an heir at law or in any way interested as a distributee in any property under the laws of descent and distribution may apply to either the probate court or the superior court mentioned in Code Section 53-4-30 to have his claim of heirship and quantity of interest established. The petition in such a case shall contain the same averments as to all parties at interest required of persons filing petitions under Code Section 53-4-31, the person charged with the duty of distribution being named as a party, and shall be verified under the oath of the petitioner.
