80.150 Condemnation authorized -- Procedure. If it becomes necessary to condemn property for the purpose of constructing any housing <br>that an authority may be permitted to acquire, establish, and operate under KRS <br>80.020(1), or securing rights of way leading thereto, the authority may, by resolution <br>reciting the need, order the condemnation of any land or improvement or interest in land, <br>that it deems necessary. Proceedings for the condemnation shall be in the Circuit Court of <br>the county in which the property lies, and shall be conducted in the name of the authority. <br>The city attorney shall conduct the proceedings for the authority. The judgment of the <br>court shall vest title in fee simple to the property condemned in the authority. In all other <br>respects the form and manner of the proceedings shall be the same as that provided in the <br>Eminent Domain Act of Kentucky. No payment or award in any condemnation <br>proceedings, or for the cost or expense of the proceedings, shall be made except from <br>funds provided under the authority of this chapter.
