216B.071 Long-term care facilities for patients with Alzheimer's disease exempt from certificate of need. (1) Notwithstanding any other provisions of this chapter, long-term care facilities for patients with a primary diagnosis of Alzheimer's disease may be constructed <br>without obtaining a certificate of need if all the following conditions are met: <br>(a) The facility provides care exclusively to patients with a primary diagnosis of Alzheimer's disease; (b) No governmental funds are expended for the construction of the facility or for care of patients for a period of five (5) years; and (c) Construction is completed by July 15, 1991. (2) Notwithstanding any other provisions of this chapter, beginning July 15, 1990, senior citizens boarding homes which do not accept payment from the Kentucky <br>Medical Assistance Program or Medicare shall be exempt from the provisions of <br>this chapter if the senior citizens boarding homes are operating prior to July 15, <br>1990.
