§ 113‑293. Obstructing rivers or creeks; keeping open fishways in dams.

(a), (b) Repealed by Session Laws 1979, c. 830, s. 1.

(c)        It is unlawful for any person in inland fishing waters:

(1)        To set a net of any description across the main channel ofany river or creek;

(2)        To erect so as to extend more than three fourths of thedistance across any river or creek any stand, dam, weir, hedge, or otherobstruction to the passage of fish;

(3)        To erect any stand, dam, weir, or hedge in any part of ariver or creek required to be left open for the passage of fish; or,

(4)        Having erected any dam where the same was allowed, to failto make and keep open such slope or fishway as may be required by law to bekept open for the free passage of fish.

The provisions of this section may not be construed to conflict in anyway with the laws and rules of any other agency with jurisdiction over theactivity or subject matter in question.
