§ 161‑26.  Dutiesunperformed at expiration of term.

Whenever, upon the termination for any cause of the term of office ofthe register of deeds, it appears that he has failed to perform any of theduties of his office, the board of commissioners shall cause the same to beperformed by another person or the successor of any such defaulting register.Such person or successor shall receive for his compensation the fees allowedfor such services, and if any portion of the compensation has been paid to suchdefaulting register, the same may be recovered by the board of countycommissioners, by suit on his official bond, for the benefit of the county orperson injured thereby.
