§ 58‑39‑65. Previous adverse underwriting decisions.

No insurance institution oragent may base an adverse underwriting decision in whole or in part:

(1)        On the fact of aprevious adverse underwriting decision or on the fact that an individualpreviously obtained insurance coverage through a residual market mechanism:Provided, however, an insurance institution or agent may base an adverseunderwriting decision on further information obtained from an insuranceinstitution or agent responsible for a previous adverse underwriting decision;

(2)        On personalinformation received from an insurance‑support organization whose primarysource of information is insurance institutions: Provided, however, aninsurance institution or agent may base an adverse underwriting decision onfurther personal information obtained as the result of information receivedfrom such insurance‑support organization.
