§ 58‑58‑225. Reporting requirements and privacy.

(a)        Each licensee shallfile with the Commissioner on or before June 1 of each year an annual statementcontaining such information as the Commissioner prescribes by administrativerule.

(b)        Except as otherwiseallowed or required by law, a provider, broker, insurance company, insuranceproducer, information bureau, rating agency or company, or any other personwith actual knowledge of an insured's identity shall not disclose that identityas an insured, or the insured's financial or medical information, to any otherperson unless the disclosure:

(1)        Is necessary toeffect a viatical settlement between the viator and a provider and the viatorand insured have provided prior written consent to the disclosure;

(2)        Is provided inresponse to an investigation or examination by the Commissioner or any othergovernmental officer or agency or pursuant to the requirements of G.S. 58‑58‑270;

(3)        Is a term of orcondition to the transfer of a policy by one provider to another provider;

(4)        Is necessary topermit a financing entity, related provider trust, or special purpose entity tofinance the purchase of policies by a provider and the viator and insured haveprovided prior written consent to the disclosure;

(5)        Is necessary toallow the provider or broker or its authorized representatives to make contactsfor the purpose of determining health status; or

(6)        Is required topurchase stop‑loss coverage. (2001‑436, s. 3.)
