§ 74D‑5.  Powers of theBoard.

(a)        In addition to thepowers conferred upon the Board elsewhere in this Chapter, the Board shall havethe power to:

(1)        Promulgate rulesnecessary to carry out and administer the provisions of this Chapter includingthe authority to require the submission of reports and information by licenseesunder this Chapter;

(2)        Determine minimumqualifications and establish minimum education, experience, and trainingstandards for applicants and licensees under this Chapter;

(3)        Conductinvestigations regarding alleged violations and make evaluations as may benecessary to determine if licensees and registrants under this Chapter arecomplying with the provisions of this Chapter;

(4)        Adopt and amendbylaws, consistent with law, for its internal management and control;

(5)        Investigate andapprove individual applicants to be licensed or registered according thisChapter;

(6)        Deny, suspend, orrevoke any license issued or to be issued under this Chapter to any applicantor licensee who fails to satisfy the requirements of this Chapter or the rulesestablished by the Board. The denial, suspension, or revocation of such licenseshall be in accordance with Chapter 150B of this General Statutes of NorthCarolina;

(7)        Issue subpoenas tocompel the attendance of witnesses and the production of pertinent books,accounts, records, and documents. The district court shall have the power toimpose punishment pursuant to G.S. 5A‑21 et seq. for acts occurring inmatters pending before the Board which would constitute civil contempt if theacts occurred in an action pending in court; and

(8)        Contract forservices as necessary to carry out the functions of the Board.

(b)        The chairman of theBoard or his representative designated to be a hearing officer may conduct anyhearing called by the board for the purpose of denial, suspension, orrevocation of a license or registration under this Chapter. (1983,c. 786, s. 1; 1987, c. 827, s. 1; 1999‑456, s. 21.)
