§ 89A‑3.1.  Board'spowers and duties.

The Board shall have thefollowing powers and duties:

(1)        Administer andenforce the provisions of this Chapter.

(2)        Adopt rules toadminister and enforce the provisions of this Chapter.

(3)        Examine anddetermine the qualifications and fitness of applicants for registration andrenewal of registration.

(4)        Determine thequalifications of firms, partnerships, or corporations applying for acertificate of registration.

(5)        Issue, renew, deny,suspend, or revoke certificates of registration and conduct any disciplinaryactions authorized by this Chapter.

(6)        Establish andapprove continuing education requirements for persons registered under thisChapter.

(7)        Receive andinvestigate complaints from members of the public.

(8)        Conductinvestigations for the purpose of determining whether violations of thisChapter or grounds for disciplining registrants exist.

(9)        Conductadministrative hearings in accordance with Article 3 of Chapter 150B of theGeneral Statutes.

(10)      Maintain a record ofall proceedings conducted by the Board and make available to registrants andother concerned parties an annual report of all Board action.

(11)      Employ and fix thecompensation of personnel that the Board determines is necessary to carry out theprovisions of this Chapter and incur other expenses necessary to perform theduties of the Board.

(12)      Adopt and publish acode of professional conduct for all registrants.

(13)      Adopt a sealcontaining the name of the Board for use on all certificates of registrationand official reports issued by the Board.

(14)      Retain privatecounsel subject to G.S. 114‑2.3. (1997‑406, s. 4; 1997‑456, s. 27; 2002‑168,s. 7.)
