§ 90C‑35.  Reports;immunity from suit.

Any person who has reasonablecause to suspect malpractice, misconduct, or incapacity of a person who islicensed pursuant to this Chapter or who has reasonable cause to suspect thatany person is in violation of this Chapter should report the relevant facts tothe Board. Upon receipt of a charge or upon its own initiative, the Board maygive notice of an administrative hearing pursuant to Chapter 150B of theGeneral Statutes or may, after diligent investigation, dismiss unfoundedcharges. Any person making a report pursuant to this section shall be immunefrom criminal prosecution or civil liability based on that report unless theperson knew the report was false or acted in reckless disregard of whether ornot the report was false. (2005‑378, s. 2.)
