12-1602. Service of writ and answer


A. For state employees who are not employees of a state university, the writ of
garnishment shall be served upon the assistant director for finance in the department of
administration in garnishment of state salaries or wages. For state employees who are
employed by a university the writ of garnishment shall be served upon the chief
disbursing officer of the appropriate state university in garnishment of state salaries
or wages paid by the university.


B. For employees of counties in this state, the writ of garnishment shall be served
on the clerk of the board of supervisors in garnishment of county salaries or wages. For
employees of all other political subdivisions of the state, the writ of garnishment shall
be served upon a designated chief disbursing officer of the political subdivision in
garnishment of salaries or wages paid by such political subdivisions.


C. If the state is named as garnishee, the attorney general shall answer the
writ. If a county or other political subdivision is named as garnishee, its legal
representative shall answer the writ.
