12-2211. Attendance of witnesses; punishment
for failure to appear or testify
A. A witness summoned in an action shall attend the court from day to day until
discharged by the court or, with the court's permission, by the party summoning him.
B. A witness summoned who fails to appear may be punished for contempt of court,
and a warrant for the arrest of such witness may be issued to compel his attendance.
C. A witness summoned or otherwise in attendance who refuses to testify may be
committed to the county jail until he consents to testify or until discharged as provided
by law.
D. No punishment for contempt shall be imposed upon a witness, nor shall a warrant
for his arrest be issued until it appears that the lawful fees have been paid or tendered
to the witness.
