13-3456. Possession or possession with intent
to use imitation controlled substance; violation;
classification


A. It is unlawful for any person to possess or possess with intent to use an
imitation controlled substance.


B. It is no defense to prosecution under this section that the defendant believed
the imitation controlled substance to be a legitimate controlled substance.


C. A person who violates subsection A by the possession or the possession of with
intent to use an imitation controlled substance is guilty of a class 2 misdemeanor.
