15-381. Liabilities of the governing board;
payment of liabilities; immunity


A. The governing board is liable as such, in the name of the school district, for a
judgment against the district for salary due a teacher on contract and for all debts
contracted under this title. It shall pay judgments or liabilities from the school
monies to the credit of the district.


B. The governing board members shall have no personal liability for acts done in
reliance upon written opinions of the attorney general or upon written opinions of the
county attorney:


1. Which are deemed to be affirmed by the attorney general pursuant to section
15-253.


2. With which the attorney general concurs.


3. Which the attorney general declines to review.


4. As revised by a written opinion of the attorney general.


C. Members of a governing board are immune from personal liability with respect to
all acts done and actions taken in good faith within the scope of their authority during
duly constituted regular and special meetings.
