15-744. Exemptions


A. The governing board of a school district may exempt pupils who are limited
English proficient and who are enrolled in an instructional program as prescribed in
section 15-754 from the nationally standardized norm-referenced achievement testing
requirement prescribed by this article for not to exceed three consecutive school
years. The first year of the exemption is the first academic year in which the pupil is
enrolled in a school district in this state in grade two or above. The instructional
program for limited English proficient pupils who are exempt from the nationally
standardized norm-referenced achievement testing requirement as provided in this
subsection shall include an alternative assessment of achievement to be administered
annually.


B. School districts shall annually report the number of pupils by category and by
grade level which were exempt as provided in this section to the department of
education. The department shall include this information in its annual report to the
legislature pursuant to section 15-743.


C. At the request of a pupil's parent or guardian, the governing board of a school
district shall administer any test required by this article to pupils exempted from the
testing requirement pursuant to this section. Test results for these pupils shall not be
included in the summary results of tests prescribed in section 15-743, but individual
results shall be sent to the school and to the parent or guardian.
