20-268. Motor vehicle subrogation


A. If a motor vehicle claim is subject to subrogation, the insured may bring a
cause of action separate and apart from the insurer seeking recovery of damages for which
the insured has not been compensated by the insurer. Any settlement or judgment of the
claim of the insured alone shall not affect the rights of the insurer.


B. If requested in writing by an insured, the insurer shall report to the insured
the status of the subrogated claim.
