20-344. Uniform plans


A. Except as provided in subsections B and C of this section, every rating
organization and every insurer that transacts workers' compensation insurance in this
state shall adhere to plans approved by the director as the uniform statistical plan,
uniform classification plan and uniform experience rating plan for the state.


B. A rating organization may use its own statistical plan to the extent that the
statistical plan does not materially conflict with the uniform statistical plan for the
purposes of making all reports to the statistical agent designated by the director
pursuant to section 20-371, subsection D. The rating organization shall file its
statistical plan with the director and receive the director's approval before using its
own statistical plan.


C. An insurer may directly or through the rating organization of which it is a
member develop subclassifications of the uniform classification plan. The insurer, or a
rating organization on the insurer's behalf, shall file each subclassification and the
rate for the subclassification with the director, and they shall be on file for a waiting
period of at least fifteen days before they become effective. The director shall
disapprove the subclassification if the insurer fails to demonstrate that the data
produced by the subclassification can be reported consistently with the uniform
classification plan and uniform statistical plan or the rate of the subclassification
does not meet the standards of section 20-356, paragraph 1.
