26-1002. Persons subject to the code


A. The following persons are subject to the code:


1. Members of the national guard.


2. All other persons lawfully ordered to duty with the national guard from the
dates they are required to serve by the terms of the order or other directive calling
them into service.


B. The voluntary enlistment of any person who has the capacity to understand the
significance of enlisting in the national guard is valid for purposes of jurisdiction
under subsection A and a change of status from civilian to member of the national guard
is effective on the taking of the oath of enlistment.


C. Notwithstanding any other provision of law, a person serving with the national
guard who submits voluntarily to military authority, meets the mental competency and
minimum age qualifications for enlistment at the time of voluntary submission to military
authority, receives military pay or allowances and performs military duties is subject to
this chapter until such person's active service has been terminated in accordance with
law or rules adopted by the Governor.
