27-1202. Coordination of programs and
activities


A. The state mine inspector shall employ staff who have the necessary and
appropriate experience in aggregate mining and reclaiming aggregate mined lands.


B. Except as provided by subsection C, the authority to administer aggregate mined
land reclamation is conferred on the state mine inspector as provided in this chapter.


C. Subsection B of this section does not apply to a city or town that adopted an
ordinance before January 1, 2005 requiring aggregate mined land reclamation. This section
does not affect the legal status of nonconforming uses in a city or town.


D. The requirements of a reclamation plan under this chapter and a floodplain use
regulation for the same aggregate mining unit or exploration operation, including any
financial assurance requirements, shall not contradict or be redundant or inconsistent
with the requirements of this chapter.


E. This chapter does not supersede the requirements of a county flood control
district to maintain stability and the flood carrying capacity of the floodplain.


F. This chapter does not supersede the requirements of title 49 or any other
applicable federal, state or local law.
