28-2261. Alternative proportional registration
agreements; authority; rules


A. In lieu of the registration required by section 28-2153, in lieu of
international proportional registration pursuant to article 7 of this chapter and
notwithstanding section 28-2321, the director may provide for the apportionment of
registration and other fees for resident or nonresident fleets of apportionable
commercial vehicles that are engaged in interstate and intrastate commerce between this
state and another state or states in which fleets operate in accordance with a
proportional registration agreement pursuant to this article.


B. The director may enter into proportional registration agreements with another
state or states providing that residents of the other state or states who operate a
commercial vehicle may allocate and apportion the registration and other fees and taxes
for the commercial vehicle prescribed in sections 28-2003, 28-5433, 28-5471 and 28-5801
pursuant to a formula agreed on by the director and the other state or states.


C. The director may enter into an agreement pursuant to this article if residents
of this state are granted the same allocation and apportionment privileges for commercial
motor vehicles registered in the other state or states. An agreement, arrangement,
declaration or amendment entered into pursuant to this article shall be in writing and is
not effective until filed with the department.


D. The director shall adopt rules necessary to administer and enforce this article.
