28-3314. License reexamination

A. If the department has good cause to believe that a licensed driver is incapable
of operating a motor vehicle pursuant to section 28-3306, subsection A, paragraph 5 or is
otherwise not qualified to be licensed, the department may require the licensee to
submit to an examination as prescribed by the department after the department gives at
least five days' advance written notice to the licensee. After the examination, the
department shall take action as appropriate and may:

1. Suspend or revoke the license.

2. Permit the licensee to retain the license.

3. Restrict the licensee's driving privileges as permitted under section 28-3159.

B. Refusal or neglect of the licensee to submit to the examination under this
section is grounds for suspension or revocation of the license.

C. The department may use accident information received pursuant to this title and
from other governmental agencies to determine if good cause exists to believe that a
licensed driver is incapable of operating a motor vehicle pursuant to section 28-3306,
subsection A, paragraph 5 or is otherwise not qualified to be licensed.
