28-4495. Permits; cancellation; cease and
desist order; hearing
A. Notwithstanding any other law, if the licensee or exhibitor is conducting an
off-premises exhibition, off-premises display and sale or special event pursuant to a
permit granted under section 28-4401, on determining that grounds for cancellation of an
off-premises exhibition permit, off-premises display and sales permit or a special event
permit exist, the director may issue a cease and desist order and notice of cancellation
of the permit to the licensee or exhibitor.
B. If the director determines that the licensee or exhibitor has failed to obtain a
permit authorized under section 28-4401 for an off-premises exhibition, off-premises
display and sale or special event, the director may issue a cease and desist order and
may suspend the privilege of obtaining subsequent off-premises exhibition permits,
off-premises display and sales permits and special event permits for the licensee or
exhibitor for a period of one year from the date of suspension.
C. A licensee or exhibitor whose off-premises exhibition permit, off-premises
display and sales permit or special event permit privileges are canceled or suspended may
request a hearing to show cause why the permit privileges should not be canceled or
suspended. At the time and place fixed by the director, the licensee or exhibitor shall
appear and be heard. Other persons the licensee or exhibitor desires may be present and
may testify at the hearing.
