32-1747. Right to examine and copy
evidence


In connection with the investigation by the board on its own motion or as the result
of information received pursuant to section 32-1744, the board or its duly authorized
agents or employees may examine and copy during normal business hours any documents,
reports, records or other physical evidence of any person being investigated, or the
reports, the records and any other documents maintained by and in possession of any
hospital, clinic, physician's office, laboratory, pharmacy or other public or private
agency, and any health care institution as defined in section 36-401, if the documents,
reports, records or evidence relates to competence, unprofessional conduct or the mental
or physical ability of a licensee to safely practice the profession of optometry.
