32-2555. Injunctions


A. The superior court may issue an injunction to enjoin:


1. A person who is not licensed pursuant to this chapter or who is not exempt from
licensure pursuant to this chapter from performing health care tasks.


2. A physician assistant from performing health care tasks if the court determines
that the licensee will or may cause irreparable damage to the public health and safety
before the board has an opportunity to act pursuant to section 32-2551.


3. An act proscribed in section 32-2554, subsection B.


B. In a petition for an injunction pursuant to subsection A, paragraph 1 of this
section, it is sufficient for the petitioner to charge that the respondent on a day
certain in a named county engaged in the performance of health care tasks without being
licensed or exempt from licensure pursuant to this chapter. It is not necessary for the
petitioner to show damage or injury.


C. In a petition for an injunction pursuant to subsection A, paragraph 2 of this
section, the petitioner shall specify the facts regarding the licensee's threat to the
public health and safety.


D. The board shall file the petition in the superior court in Maricopa county or in
the county where the respondent resides or is found.
