36-108. Indirect cost fund; use;
exemption
A. A department of health services indirect cost fund is established. Federal
monies, monies collected from interagency agreements and other monies obtained for the
purposes of reimbursing the department for administrative costs shall be deposited,
pursuant to sections 35-146 and 35-147, in the fund.
B. Subject to legislative appropriation, monies in the fund shall be used for
administrative personnel and overhead costs associated with administering federal
programs, interagency agreements and other programs paying assessments into the fund.
C. Monies in the fund are exempt from the provisions of section 35-190 relating to
lapsing of appropriations.
