36-143. Care and treatment for residents
twenty-one and older with cystic fibrosis; costs


A. The department of health services may develop and conduct a program of care and
treatment services through appropriate treatment facilities for residents of this state
suffering from cystic fibrosis who are twenty-one years of age and older. Costs of the
program shall be borne by the state, subject to appropriation, except as provided by
subsection B.


B. Care and treatment services shall be provided without cost to indigents as
defined by the rules and regulations of the department of economic security. The cost of
care and treatment services for indigents shall be borne by the county in the same manner
as costs for medical care for the indigent sick of the county pursuant to title 11,
chapter 2, article 7. All other persons shall pay, either directly or through some form
of third-party coverage, for at least a portion of the costs of provided services based
on a cost-sharing system established by the director of the department of health
services. The cost-sharing system shall take into consideration the income and family
size of the recipient and be adjusted annually to reflect fluctuations in the cost of
living index.
