36-1473. Finding of necessity by local
governing body


A. A municipality shall not exercise any of the powers conferred on municipalities
by this article until its local governing body adopts a resolution by a two-thirds vote
finding both of the following:


1. One or more slum or blighted areas exist in the municipality.


2. The redevelopment of that area or areas is necessary in the interest of the
public health, safety, morals or welfare of the residents of the municipality.


B. A municipality must notify the owner of real property that is within the
boundaries of a proposed redevelopment area of the time, date and location of a public
meeting concerning the findings. The municipality must provide this notice by first class
mail to the address stated on the most recent records of the county assessor.
