36-183. Boards of health of local health
departments; membership; terms


A. Except as provided in subsection B, for a county department of health in a
county having three supervisorial districts, the board of supervisors shall appoint a
board of five members consisting of a member of the board of supervisors, a physician
licensed pursuant to title 32, chapter 13 or 17 and three citizens selected for their
interest in public health, each citizen member to be a resident of a different
supervisorial district, so that each supervisory district in the county has a
representative on the board. The member selected from the board of supervisors shall
serve during that member's term of office. The term of office of the physician member
and of the citizen members shall be four years.


B. In a county having three supervisorial districts, the board of supervisors may
determine by majority vote to appoint a board of nine members for the county department
of health. In the event a board of supervisors determines to appoint a nine member
board, the board shall consist of a member of the board of supervisors, a physician
licensed pursuant to title 32, chapter 13 or 17, a member of a city governing body
selected by the board and six citizens selected for their interest in public health. The
citizen members shall be residents of different supervisorial districts, so that each
supervisorial district in the county has two representatives on the board. The members
selected from the board of supervisors and the city governing body shall serve during
their terms of office. The term of office of the physician member and the citizen members
shall be four years. In the event four additional members are appointed pursuant to this
subsection, the city governing body member shall be appointed for a term of four years,
one citizen member shall be appointed for a term of one year, one citizen member shall be
appointed for a term of two years and one citizen member shall be appointed for a term of
three years.


C. In a county having five supervisorial districts, the board of supervisors shall
appoint a board of eleven members consisting of a member of the board of supervisors, a
physician licensed pursuant to title 32, chapter 13 or 17 and five citizen members
selected for their interest in public health, each citizen member to be a resident of a
different supervisorial district so that all five supervisorial districts in the county
have representatives on the board. In addition, four citizen members shall be appointed
from the county at large. The term of office of the physician member and each member
appointed pursuant to this subsection shall be four years.


D. Appointment to fill a vacancy in the membership of a board caused other than by
expiration of term shall be for the unexpired portion of the term.


E. The director of a county health department shall serve, without vote, as an ex
officio member of the board.


F. Citizen members appointed pursuant to this section shall not be county health
department employees.
