36-1921. Persons not affected by
chapter

This chapter does not:

1. Apply to a person while engaged in the practice of recommending hearing aids if
such practice is part of the academic curriculum of an accredited institution of higher
education or part of a program conducted by a public or charitable institution, or a
nonprofit organization which is primarily supported by voluntary contributions unless
they sell hearing aids.

2. Apply to any person engaging in the practice of measuring human hearing for the
purpose of selection of hearing aids provided that the person or the organization that
employs that person does not sell hearing aids or hearing aid accessories.

3. Prevent a health care professional who is licensed or certified under title 32
from acting within the scope of that person's license or certificate.

4. Apply to a person who is credentialed by this state as a teacher of the deaf
from acting within the scope of those credentials.

5. Apply to a student, intern or trainee pursuing a course of study in audiology or
speech-language pathology in a nationally or regionally accredited institution of higher
education or training institution if all of the following are true:

(a) The activities are part of a planned course of study at that institution.

(b) The person is designated by a title that clearly indicates the status
appropriate to the person's level of education.

(c) The person works under the supervision of a person who is licensed in this
state as an audiologist or a speech-language pathologist.

(d) Before a person receives services from a student or a temporary licensee, the
supervising licensee provides written notification of this fact to the patient.

6. Apply to any person certified by the department of health services for the
school hearing screening program.
