36-327. Disinterment-reinterment permit

A. Except as otherwise provided by law, a disinterment-reinterment permit is
required before a person disinters human remains. The state registrar shall provide a
permit to disinter human remains either by a court order issued in this state or by the
written consent of the decedent's family member who has the highest priority. The order
of priority is the same as provided in section 36-831.

B. A disinterment-reinterment permit is not required if disinterment and
reinterment occur in the same cemetery for ordinary relocation or for reasons of internal
management of the cemetery.
