36-593. Adult developmental homes; child
developmental foster homes; secure facilities; provisional
licenses


A. The department may issue a provisional license to an applicant or licensee who
is temporarily unable to conform to standards of care established by the department if
the deficiencies can be remedied within six months.


B. A provisional license is valid for six months and shall not be renewed.


C. The department shall not issue a provisional license if conditions exist that
could endanger the health and safety of clients residing in the setting.


D. If the department determines that the applicant or licensee meets the standards
established by the department, it shall issue a regular license. The regular license is
valid for one year from the date the department issued the provisional license.
