37-610. Disposition of surplus floodplain lands
A. If the department manages surplus floodplain lands acquired from the
department of emergency and military affairs, the commissioner may transfer the land to
an appropriate political subdivision of this state if the land will be used for public
parks and recreation facilities.
B. The commissioner shall evaluate each request pursuant to this section and, if
the commissioner determines that a transfer would serve the best interest of this state
and the public in the area in which the surplus land is located, the commissioner shall
recommend to the state selection board that the transfer be approved.
C. If the state selection board approves the transfer, the department shall offer a
patent transferring the surplus land to the political subdivision. Any patent offered
under this subsection shall require that the land immediately revert to this state if the
land is not used for the public purpose for which it was conveyed.
