37-702. Application for selection of arid lands
for irrigation projects or reclamation projects; proposal;
deposit


A. Any person desiring to construct irrigation works or to reclaim lands under the
provisions of this article shall file with the state land department an application for
selection of the lands to be reclaimed. The application shall be accompanied by a
proposal for complete reclamation of the lands so designated.


B. The proposal shall state:


1. The source and right of the water supply acquired or to be acquired.


2. The location and layout of the works constructed, in process of construction or
proposed.


3. The maximum price and terms per acre at which perpetual water rights will be
sold to settlers on the land to be reclaimed.


4. The maximum price per acre per annum for maintenance charges.


C. If the applicant is a corporation, the proposal shall state:


l. The purposes for which the corporation is organized.


2. The names and residences of its directors and officers.


3. The amount of its authorized and paid-up capital.


D. If applicant is not a corporation, the proposal shall set forth the names of the
parties and such facts as will enable the commissioner to determine their financial
ability to carry out the proposed enterprise.


E. A certified check in a reasonable sum required by the department, but not less
than two hundred fifty dollars, shall accompany each proposal to be held as guaranty for
the execution of the contract with the state in accordance with its terms, if the
proposal is approved by the department.
