38-363. Withholding or destruction of records
or property of office by former officer; classification


A public officer whose office is abolished by law, or who, after expiration of the
time for which he has been appointed or elected, or after he has resigned or been legally
removed from office, knowingly and unlawfully withholds or detains from his successor, or
other person entitled thereto, the records, papers, documents or other writings
pertaining or belonging to his office, or who knowingly mutilates, destroys or takes away
any thereof, or who knowingly and unlawfully withholds or detains from his successor, or
other person entitled thereto, any money or property in his custody as such officer, is
guilty of a class 4 felony.
