38-606. Suspension of salary pending
determination of contested title to office; exception


A. When the title of the incumbent of any office is contested by proceedings
instituted for that purpose, no warrant shall be drawn or paid for any part of such
officer's salary, except when otherwise provided by the law relating to contests of
elections, until the proceedings have been finally terminated.


B. As soon as such proceedings are instituted, the clerk of the court in which they
are pending shall certify the facts to the officers whose duty it would otherwise be to
draw the warrant or pay the salary.
