38-608. Compensation or time off for legal
holidays


A. All public employees who work forty hours or more per week who do not receive
either compensation or commensurate time off for legal holidays worked, regardless of the
day of the week on which such legal holidays fall, shall receive, for each such holiday
worked, one day additional vacation leave or one day additional compensation for each
such legal holiday worked.


B. For the purposes of this section, unless the context otherwise requires:


1. "Legal holiday" includes Christmas, Thanksgiving, Labor day, New Year's day and
Independence day.


2. "Public employee" includes the employees of the state, a county, city, town or
any other political subdivision of the state, but does not include irrigation, power,
electrical, agricultural, improvement, drainage and flood control districts, and
tax-levying public improvement districts organized pursuant to law.
