40-105. Executive director; appointment; powers
and duties

A. The corporation commission shall appoint an executive director, who shall have
the power to serve warrants and other process in any county of the state.

B. The executive director shall if directed by the commission:

1. Keep a record of all proceedings of the commission, issue necessary writs,
warrants and notices, and perform other duties the commission prescribes.

2. Supervise and administer the overall activities of the commission divisions and
employees.

3. Employ experts, engineers, statisticians, accountants, inspectors and employees
necessary to perform the duties and exercise the powers of the commission.

4. Make and submit to the governor and legislature an annual report containing a
complete account of the commission's transactions and proceedings for the preceding
fiscal year, together with other facts, suggestions and recommendations of value to the
people of this state.

C. The executive director may if directed by the commission:

1. Act as the authorized officer of the commission when performing duties necessary
for processing rules adopted by the commission.

2. Contract for the services of outside advisers, consultants and aides reasonably
necessary or desirable to enable the commission to adequately perform its duties.

3. Contract and incur obligations reasonably necessary or desirable within the
scope of commission activities and operations to enable the commission to adequately
perform its duties.

4. Use monies, facilities or services to provide matching contributions for other
governmental programs which further the objectives and programs of the commission.

5. Employ attorneys to represent the commission and each commissioner as provided
in section 40-106.

6. Establish accounts for the purpose of receiving and expending monies for
educational and safety programs within the scope of the duties of the commission.
