40-1117. Condemnation privilege
The authority may use the provisions of law relating to eminent domain. No
provision for eminent domain given to the authority by this section or by any provision
of law may be exercised against property or any franchise of a common carrier of
passengers when a territory is being adequately served by such common carrier of
passengers under authority of law. Such condemnation proceedings shall only be
applicable to property located within the area of the authority.
