40-353. Application of article; reinstallation
of overhead facilities prohibited


A. The provisions of this article shall apply only to the relocation underground of
existing utilities.


B. Once removed, no overhead electric or communication facilities shall be
installed in an underground conversion service area.


C. Following the conversion of overhead electric or communication facilities, the
public service corporation or public agency whose facilities were converted may install
lines or facilities used or intended to be used for the transmission of electric energy
at nominal voltages in excess of twenty-five thousand volts or having a current carrying
capacity in excess of twelve thousand kva, provided that prior to the installation of
such facilities the public service corporation or public agency desiring to install such
facilities shall pay to the then existing owners of real property within the underground
conversion service area the principal cost paid by such owners and their predecessors in
interest for the conversion of overhead electric or communication facilities.
