41-1606. Access to prisoner medical history
information


A. Notwithstanding any law to the contrary, in order to facilitate prison and
inmate management the director, assistant directors, wardens and deputy wardens of the
state department of corrections on request shall have access to any prisoner medical
history information that is maintained by the department and that has an impact on the
administration of the prison system or on the welfare of the inmate population.


B. The director, assistant directors, wardens and deputy wardens shall keep
confidential the prisoner medical history information that they receive pursuant to
subsection A, except that the director, assistant directors, wardens and deputy wardens
may use the medical history information to establish for department employees
precautionary procedures and guidelines for the care, transportation and housing of
inmates whose medical histories indicate a need for special management.
