41-2061. Administration of chapter; director;
appointment; compensation; search committee; advisory
committee


A. The director shall administer the provisions of this chapter.


B. The director shall be appointed by the governor pursuant to section 38-211 from
the names submitted by the search committee in accordance with subsection C of this
section and is eligible to receive compensation pursuant to section 38-611.


C. A search committee is established for the purpose of soliciting and screening
applicants and submitting up to three names to the governor for the position of director
of the department when a vacancy in the office of director exists. The governor may
reject the names submitted by the search committee and direct the search committee to
submit additional names for consideration. The committee shall consist of nine members
appointed by the governor from the following groups:


1. One member representing retail trade.


2. One member representing wholesale trade.


3. One member representing the liquid petroleum industry.


4. One member representing agriculture.


5. One member representing the weight and measure manufacturing industry.


6. Four members representing consumers.


D. The names for director shall be chosen based on practical experience, training
and knowledge in weights and measures practices, procedures, laws and administrative
functions. Members of the search committee shall select a chairman from the membership,
and members of the search committee are not eligible to receive compensation or
reimbursement of expenses.


E. The director may appoint an advisory committee consisting of five members to
review, advise and make recommendations to the director in the administration of the
provisions of this chapter and regarding proposed rules provided for in this chapter.
