41-2156. Notification and correction of
defects by manufacturer; notice to purchaser


A. Every manufacturer of units shall furnish notification of any defect in any unit
produced by such manufacturer which he determines, in good faith, relates to a
construction or safety standard adopted pursuant to this chapter or contains a defect
which constitutes an imminent safety hazard to the purchaser of such unit, within sixty
days after such manufacturer has discovered the defect. Every manufacturer of units
shall maintain a record of the names and addresses of the purchaser of each unit for the
purposes of this section. Such information shall be provided by the dealer or broker
upon purchase of each unit and reported monthly to the manufacturer.


B. The notification required by subsection A shall contain a clear description of
such defect or failure to comply with such construction or safety standards, an
evaluation of the risk to the occupants' safety reasonably related to such defect and a
statement of the measures needed to repair the defect. The notification shall also
inform the owner whether the defect will be corrected at no cost to the purchaser of the
unit or at the expense of the purchaser.
