41-2604. Authority for transfer of
material

Notwithstanding any law to the contrary, the governing board, or in case there is
none, the executive head of any state governmental unit, political subdivision or
nonprofit institution determined to be eligible to receive surplus materials, may confer
on any officer or employee thereof continuing authority to secure the transfer to it of
surplus materials and to obligate its monies to the extent necessary to comply with the
laws and conditions of such transfers. The director shall adopt rules establishing
guidelines for use in determining eligibility.
