41-2817. Community based care
A. The department shall establish and operate or contract for the operation of a
system of community based programs to supervise and rehabilitate youth in the least
restrictive environment consistent with public safety and the needs of the youth. The
programs shall consist of both residential and nonresidential nonsecure treatment
centers.
B. Before incurring any obligation for the establishment of a community based
residential treatment center, the department shall give at least sixty days' written
notice to the city, town and school district affected and to the county board of
supervisors for an unincorporated area. The county, city, town or school district may
contest establishment of a community based residential treatment center by written
objection filed with the department within thirty days after receiving notice and may
request a hearing to be conducted by the department pursuant to chapter 6, article 6 of
this title.
